Fire Victim's Parents File Lawsuit

PITTSBURGH - Nearly one year after a fire at Seven Springs Resort in Somerset County killed a Belle Vernon couple, the parents of one of the victims have filed a lawsuit in Pittsburgh regarding their son's death.

According to the Pittsburgh law firm of Wilkes & McHugh, Thomas and Mary Lou Murt, the parents of Jonathan Michael Murt, are suing the condominium's owner, as well as the condominium association, fireplace manufacturer, chimney-cleaning company and an acquaintance of their son for damages.

The lawsuit alleges that negligence by the defendants resulted in their son's death, according to a press release from the law firm Friday.

Murt died Jan. 27, 2008, while on a weekend ski trip with his girlfriend, Sasha Zuro, 26, and her friends.

The bodies of Murt and Zuro were found in a condominium at the resort's SunRidge Development on SunRidge Drive, state police said.

The blaze erupted around 1 a.m., destroying six condominiums, police said.

Police ruled the fire accidental.

The fire began in a fireplace of unit F-10, police said, noting that flames spread to adjoining units of the four-story building.

Police said the building was evacuated, noting that at least five of the units were occupied when the fire broke out.

The bodies of Zuro and Murt were located in unit F-12, police said.

Somerset County Coroner Wallace Miller said Zuro and Murt died of smoke inhalation.

The privately owned SunRidge condominiums are about 20 years old and overlook the valley and nearby ski resort, officials said.

More than 40 fire trucks from numerous departments responded to the blaze, police said, noting that departments from Somerset, Fayette and Westmoreland counties assisted.

According to a press release regarding the lawsuit, Murt and Zuro were at the resort after Burt Raitano II, no address available, invited the couple and other friends to spend the weekend at the condo of Raitano's father.

The night of the fire, Raitano and a companion went to the lodge for dinner and drinks, and another friend, Anthony Valkanas, no address available, went to get pizza, the lawsuit states.

Valkanas told investigators that when he returned, the door to the bedroom Murt and Zuro shared was closed, the suit alleges. The suit claims that Valkanas "stoked the fire, ate his pizza and fell asleep while watching TV."

The suit alleges that Valkanas awakened around 1 a.m. and discovered the condo was filled with smoke and flames. He allegedly told police that he saw Murt and warned him to get out of the condo before leaving to alert other residents, the suit alleges. He told police that he assumed Murt and Zuro escaped the blaze, according to the lawsuit.

The lawsuit filed last month in common pleas court in Allegheny County names Burt Raitano, Sunridge Condominium Association Inc., Barry Fitzgerald with Fitzgerald Chimney Cleaning, Anthony Valkanas, and Majestic, the manufacturer of the fireplace and chimney as defendants.
